Our online store is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, disclose, and otherwise process personal information when you visit or use the Services, place a reservation or other order, or otherwise communicate with us.

If there is a conflict between our Terms of Service and this Privacy Policy with respect to the collection, processing, use, or disclosure of personal information, this Privacy Policy controls.

We may collect personal information from the following sources:

  • Directly from you, including when you place a reservation or order, submit a form, contact us, use a customer account, or otherwise provide information to us.
  • Automatically through the Services, including from your device when you visit or use our website and through cookies or similar technologies.
  • From Shopify and our service providers, including providers that support hosting, checkout, payments, fraud prevention, customer service, analytics, communications, or other operational functions.
  • From partners or other third parties, where permitted by law and relevant to providing or protecting the Services.

How We Use Your Personal Information

Depending on how you interact with us and which Services you use, we may use personal information for the following purposes:

  • Provide and operate the Services. We use personal information to process your reservation or other transaction, process payments, provide order and reservation confirmations, maintain records, respond to refund requests, provide customer support, remember relevant preferences, and otherwise perform the services you request from us.
  • Reservation, Kickstarter, and product communications. If you place a Dirt Republic reservation, we may send service-related communications concerning your reservation, important changes, the planned Kickstarter launch, access to the reserved launch offer, campaign updates, and updates about the Dirt Republic product connected to your reservation. Placing a reservation does not, by itself, enroll you in unrelated promotional newsletters or advertising for other products.
  • Improve and personalize the Services. We may use information to understand how the Services are used, improve functionality and performance, and provide a more relevant experience.
  • Security and fraud prevention. We use information to provide a secure payment and shopping experience, authenticate activity where appropriate, detect and investigate suspected fraudulent, illegal, unsafe, or malicious activity, and protect our Services, customers, and business.
  • Communicate with you. We use personal information to respond to questions, support requests, privacy requests, reservation refund requests, and other communications.
  • Legal and compliance purposes. We may use personal information to comply with applicable law, respond to valid legal process, cooperate with lawful government requests, establish or defend legal claims, enforce our terms and policies, and protect our rights or the rights of others.

Dirt Republic does not currently use merchant-installed third-party advertising pixels such as Meta Pixel, TikTok Pixel, or Google Ads tracking pixels for behavioral retargeting. We currently focus on organic marketing. This statement does not limit or replace the disclosures below concerning Shopify's own processing and Shopify Network Intelligence.

How We Disclose Personal Information

We may disclose personal information to third parties for legitimate business purposes and subject to this Privacy Policy, including:

  • Shopify and service providers that perform services on our behalf or support the Services, such as hosting, IT, payment processing, fraud prevention, customer support, cloud storage, analytics, or communications.

Relationship with Shopify

The Services are hosted by Shopify. Shopify collects and processes personal information about your access to and use of the Services to provide, protect, and improve the Shopify platform and the Services available through our store. Information you submit through the Services may be transmitted to and processed by Shopify and other service providers, including in countries other than the country where you reside.

Shopify Network Intelligence is currently enabled for our store. Through Shopify Network Intelligence and related Enhanced Services, Shopify may process data from interactions with our store together with data from interactions with Shopify and other Shopify merchants to support services such as fraud and risk protection, product and store improvements, personalization, performance measurement, and advertising-related features. Other merchants do not receive access to our customer data. Shopify is responsible for certain processing it performs for these Enhanced Services.

Where applicable, Shopify's customer privacy tools and consent choices can affect how data is used for these purposes. Our inclusion of a link does not, by itself, imply endorsement of that third party or its services.

Children's Data

The Services are not intended for use by children, and we do not knowingly collect personal information from children under the age of majority applicable in their jurisdiction. If you are a parent or guardian and believe that a child has provided personal information to us, please contact us using the details below so that we can review and, where appropriate, delete the information. We do not have actual knowledge that we sell or share, as those terms are defined under applicable law, personal information of individuals under 16 years of age.

Where applicable, Shopify may also recognize Global Privacy Control signals through its customer privacy tools.
  • Communication preferences. Reservation confirmations, launch-access messages, campaign updates, and material product updates connected to your reservation are service-related communications. If we later offer optional promotional marketing and you separately opt in, you may opt out of those promotional communications using the unsubscribe method provided in the message. Opting out of promotional marketing does not prevent us from sending non-promotional messages necessary to administer your reservation, transaction, account, or legal obligations.

If you reside in the United Kingdom or European Economic Area, subject to applicable exceptions and limitations, you may also have rights to object to certain processing, request restriction of processing, and withdraw consent where processing is based on consent. Withdrawal of consent does not affect processing that was lawful before the withdrawal.

Where permitted by law, an authorized agent may make a request on your behalf, subject to appropriate verification. We will not discriminate against you for exercising applicable privacy rights.
